Donal Trump and his campaign talked a lot about the US Department of Education possibly terminating that agency.
“We will ultimately eliminate the Federal Department of Education and send it back to the Wiconsin and back to the States”
Professor William Resh from University of Southern California, School Public Policy states “Donal Trump cannot unilaterally get rid of the department of Education under our constitutional system. Agencies are created as functional legislations, created as law. Donal Trump has no control for this function. This is the type of administrative strategy that you can put in place if you are against the policies of give piece of legislation.”
He also states “The US Department of Education can change the standards to qualify for federal funding which could include everything – from critical race theory to transgender student athletes”
“If the federal government is putting in place standards by which states have to abide in order to receive funding by the department of education even if its a small amount, the state will shift it’s standard.
Professor Resh is the author of Rethinking the Administrative Presidency.

Trump, at the end claims the US spends 3 times more money on Education than any other nation and yet “we are absolutely at the bottom, we are the worst.”
About the US Department of Education
The U.S. The Department of Education was established in 1980, President Jimmy Carter signed into law on October 17, 1979. The Department of Education oversees national education policies and programs.
Created after the Department of Health, Education, and Welfare split, it operates with a $68 billion budget and 4,400 employees, making it the smallest Cabinet department. The 2023 budget request includes $88.3 billion for programs like special education, early childhood, and pandemic recovery.
The Department of Education has four key functions:
- Setting and managing federal financial aid for education.
- Collecting school data and sharing research.
- Highlighting important educational issues.
- Ensuring equal access and preventing discrimination in education.
Adam Urbanski, President of Rochester’s Teachers Association states “The most vulnerable children in rural districts and in urban districts would pay the price and they are the ones that would be hurt. Right now the funding for education in most school districts is 8% to 10% of the money that they get.”
